1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of Explorease’s platform, including the Explorease consumer app, the Explorease Business app, and our website at explorease.tech (collectively, the “Platform”).

By accessing or using any part of our Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Platform.

2. Eligibility

You must be at least 18 years old to use the Explorease Platform. By using our Platform, you confirm that you meet this requirement. If you are under 18, you may not register an account, make bookings, or list properties or experiences.

3. Account Registration

To access certain features of the Platform, you will need to create an account. You agree to:

1. Provide accurate, current, and complete information during registration
2. Keep your account information up to date
3. Keep your password confidential and not share it with anyone
4. Notify us immediately at info@explorease.tech if you believe your account has been compromised
5. Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently.

4. The Explorease Platform

Explorease is a travel super-app that connects travelers and locals with:

1. Homes — short-term rental properties listed by verified hosts
2. Events — local events listed by verified organizers
3. Discover — curated places to visit and things to do in Kigali and across East Africa

Explorease acts as a platform connecting users. We are not a party to the agreement between travelers and hosts, and we do not own, operate, or manage any of the properties or experiences listed on the Platform.

5. Traveler Terms

5.1 Bookings

When you make a booking through Explorease, you are entering into a direct agreement with the host or event organizer. Explorease facilitates the booking but is not responsible for the property, event, or experience itself.

You agree to:

1. Provide accurate information when making a booking
2. Pay the full amount at the time of booking
3. Respect the property, its contents, and the host’s rules during your stay
4. Leave the property in the condition in which you found it
5. Treat hosts, event organizers, and other users with respect

5.2 Payments

All payments are processed securely through our third-party payment processor. By making a booking, you authorize us to charge the payment method you provide for the full booking amount including any applicable fees.

5.3 Cancellations and Refunds

Cancellation and refund terms vary by listing and are set by the individual host. Please review the cancellation policy on each listing before booking.

6. Host and Organizer Terms

6.1 Listing Your Property or Experience

To list on Explorease, you must:

1. Be the legal owner or authorized manager of the property or experience
2. Ensure your listing is accurate, up to date, and not misleading
3. Comply with all applicable local laws, regulations, and licensing requirements
4. Maintain the property or experience to a standard that meets the expectations set in your listing
5. Honor all confirmed bookings unless exceptional circumstances apply

We reserve the right to remove listings that we determine to be inaccurate, inappropriate, or in violation of these Terms.

6.2 Commission

Explorease charges a commission of 10% of the base booking price on each confirmed booking. This commission is automatically deducted before your payout is processed. The commission covers access to the platform, booking management, and payment processing.

6.3 Payouts

Payouts are processed to your registered bank account or mobile money account after a booking is confirmed and completed. Payout timelines will be communicated within the app. We reserve the right to withhold payouts in cases of suspected fraud, disputes, or violations of these Terms.

6.4 Host Cancellations

Hosts should avoid cancelling confirmed bookings. Repeated cancellations may result in penalties including reduced visibility, suspension, or removal from the platform. If you need to cancel a booking, do so as early as possible and notify the traveler through the platform.

7. Prohibited Conduct

You agree not to use the Platform to:

1. Violate any applicable law or regulation
2. List properties or experiences you do not have the right to list
3. Provide false or misleading information in your listing or profile
4. Harass, abuse, or harm other users
5. Circumvent our payment system by arranging payments outside the platform
6. Scrape, copy, or reproduce any part of the Platform without our written permission
7. Upload viruses, malware, or any code intended to disrupt or damage the Platform
8. Engage in any activity that compromises the safety or integrity of the Platform or its users

We reserve the right to remove content, suspend accounts, or take legal action in response to prohibited conduct.

8. Content

8.1 Your Content

You retain ownership of any content you submit to the Platform, including photos, descriptions, and reviews. By submitting content, you grant Explorease Ltd a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute that content solely for the purpose of operating and promoting the Platform.

You confirm that any content you submit does not infringe the intellectual property rights of any third party and does not contain anything unlawful, defamatory, or offensive.

8.2 Our Content

All content created by Explorease — including our name, logo, design, text, graphics, and software — is the property of Explorease Ltd and is protected by applicable intellectual property laws. You may not use our content without our prior written permission.

9. Reviews and Ratings

Explorease allows travelers to leave reviews and ratings for properties and experiences. You agree to:

• Leave honest and accurate reviews based on your genuine experience
• Not post reviews that are false, misleading, or intended to harm a host’s reputation unfairly
• Not offer or accept payment in exchange for reviews

We reserve the right to remove reviews that violate these guidelines.

10. Disclaimers and Limitation of Liability

Explorease provides the Platform on an “as is” basis. We do not guarantee that the Platform will be available at all times, error-free, or free from viruses or other harmful components.

To the fullest extent permitted by applicable law, Explorease shall not be liable for:

1. Any loss or damage arising from your use of the Platform
2. The conduct or content of any host, traveler, or third party
3. Losses arising from bookings, cancellations, or disputes between travelers and hosts
4. Any indirect, incidental, or consequential damages arising from your use of the Platform

Our total liability to you in connection with the Platform shall not exceed the total amount paid by you through the Platform in the 12 months preceding the claim.

11. Indemnity

You agree to indemnify, defend, and hold harmless Explorease Ltd, its directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third party’s rights.

12. Third-Party Services

The Platform may contain links to third-party websites, apps, or services. These are provided for convenience only. Explorease has no control over third-party content and accepts no responsibility for it. Your use of third-party services is governed by their own terms and policies.

13. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or if we determine it is necessary to protect the Platform or its users.

You may terminate your account at any time by deleting it through the app or by contacting us at info@explorease.tech.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Rwanda. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Rwanda.

If you have a dispute with another user of the Platform, we encourage you to contact us first so we can attempt to resolve it informally.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. If the changes are significant, we will notify you through the app or by email. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms.
